The long-running legal battle over Dearness Allowance (DA) for West Bengal government employees has entered a crucial new phase. In a significant development, the West Bengal government has moved the Supreme Court once again, filing a review petition challenging the court’s earlier ruling, raising fresh uncertainty for lakhs of state employees awaiting clarity on their DA dues.
According to legal sources, the state government has formally requested the Supreme Court to reconsider its February 5, 2026 judgment in the DA-related case. The move comes after the state had earlier submitted a modification application seeking partial changes to the order. With the latest step, the government is now asking the apex court to review the entire judgment itself.
A review petition, in legal terms, is a request made to the same court asking it to revisit its own decision if there are grounds to believe that certain aspects require reconsideration. By filing this petition, the state has effectively opened another chapter in the prolonged dispute over DA payments.
Court records indicate that the review petition was filed on March 9, 2026, at 5:48 PM. The case has been registered under the title “State of West Bengal vs Confederation of State Government Employees.”
The petition specifically challenges the Supreme Court’s order delivered on February 5, which had become a focal point in the ongoing legal struggle between the state government and employee organisations demanding DA parity with central government staff.
For government employees across West Bengal, the development has renewed speculation about the future of the case. With both the modification application and the newly filed review petition now pending before the Supreme Court, the matter remains far from resolved.
As of now, the Supreme Court has not announced any hearing date for either of the two petitions filed by the state government. Until the apex court takes up the matter again, lakhs of government employees will continue to wait for a final resolution in one of the state’s most closely watched legal disputes.
