Battle of Titans: Kapil Sibal vs Indira Jaising, A Gripping Duel in the Supreme Court

Key Issues Expected to Surface:

  1. CBI Investigation Status: The CBI has been tasked with investigating the rape and murder of a female doctor at RG Kar Medical College. The Supreme Court had earlier expressed concern over the progress of the investigation and instructed the CBI to submit a status report. The court also ordered that sensitive information not be disclosed to the public yet.
  2. Controversial Night Shift Policy for Women: The court had directed the West Bengal government to revoke its controversial notification on women working night shifts. However, it rejected demands for the resignation of Chief Minister Mamata Banerjee.
  3. Junior Doctors’ Strike: The strike by junior doctors is another focal point, with Senior Advocate Indira Jaisingh representing them in court. She argued that the understanding between the state and the doctors should be documented, emphasizing that doctors want to return to work.
  4. Six Key Directives Issued by the Supreme Court:
    • Remove the victim’s name and image from Wikipedia.
    • The CBI must address confidential issues raised in a letter by the victim’s father on September 12.
    • Restroom and CCTV facilities must be installed in the hospital after discussions with senior officials.
    • Biometric security for female doctors resting in seminar halls must be implemented.
    • The police must hand over all CCTV footage to the CBI and resolve any related issues.
    • No punitive action will be taken against junior doctors who return to work after their general body meeting.
