CJI Chandrachud Advocates for Mindset Shift: Laws Alone Cannot Ensure Gender Equality
At the She Shakti event organized by News18 Network, Chief Justice of India (CJI) D Y Chandrachud emphasized that while India has numerous laws protecting women’s rights, laws alone are insufficient to create a truly just society. He stressed the need to challenge patriarchal mindsets and foster a societal shift toward genuine equality.
Key Points from CJI Chandrachud’s Address:
- Legal Provisions Exist: CJI Chandrachud acknowledged that both substantive and procedural laws are in place to safeguard women’s rights in both public and private spheres. However, he noted that these laws, while stringent, are not enough on their own to ensure justice.
- Mindset Change is Essential: He stressed that societal attitudes must evolve. “The mindset must move from making concessions for women to recognizing their entitlement to live with freedom and equality,” said the CJI, highlighting the need for a shift from paternalistic protections to empowering women.
- Beyond the Male Default: CJI Chandrachud urged institutions and individuals to look beyond the “male default” and promote equal participation of women. He emphasized that women’s rights are not only a “women’s issue” but essential for creating a better society.
- Historical Perspective on Equality: Reflecting on India’s constitutional history, the CJI referenced Hansa Mehta, a prominent feminist who contributed to the drafting of the Indian Women’s Charter of Life. He reiterated that equality is an integral part of India’s constitutional values.
CJI Chandrachud’s address underscored that gender equality cannot be achieved through laws alone, and a societal transformation is needed to truly uphold the principles of freedom, equality, and justice for women.
